Prepare for CPSC E-Filing: Important Deadline Approaching!

The U.S. Consumer Product Safety Commission (CPSC) e-filing implementation is rapidly approaching, with a mandatory deadline set for July 8, 2026. This requirement will impact a wide range of importers, as the CPSC regulates a large variety of products. It is imperative that importers understand the requirements and are prepared for the deployment in July.

Background: What is E-Filing?

E-filing, or electronic filing, is a newly developed process for consumer product compliance data to be submitted to the CPSC electronically. This standardization aims to establish a streamlined, efficient way for the CPSC to better analyze incoming shipments, focus on higher-risk products and ensure better consumer safety to keep Americans safe. 

The CPSC is an independent federal agency tasked with protecting the public from unreasonable risks of injury or death associated with the use of thousands of types of consumer products. The new implementation requires electronic submission of specific product data before goods arrive at U.S. ports, streamlining the CPSC's ability to target and inspect potentially non-compliant or unsafe products.

Data Submission Methods: Reference Set vs. Full Message Set

Importers will have two primary ways to submit the required product data through the Automated Commercial Environment (ACE):

  1. Reference Set: This is the preferred approach recommended by the CPSC, where the importer submits certificates of compliance electronically in the registry ahead of time. In this scenario, only 3 data elements are required to be submitted at the time of entry.
  2. Full Message Set: This requires submitting more comprehensive, detailed product data, including compliance certificates and specific regulatory statements. This method is more time consuming, increases the risk of error and delay.
